1. Acceptance
These Terms of Service ("Terms") form a binding agreement between you and the operator of MORIARTY VPN ("we", "us"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and able to enter into a binding contract. You are responsible for complying with the laws that apply to you.
3. Accounts
- You must provide accurate registration information and keep it current.
- You are responsible for all activity under your account and for keeping your credentials secure. Notify us immediately of any unauthorized use.
- One account per user unless we agree otherwise. We may refuse, suspend, or terminate accounts at our discretion as permitted by law.
4. The Service
MORIARTY VPN provides access to a virtual private network on a subscription basis. The Service is provided on a commercially reasonable-efforts basis. We do not guarantee uninterrupted or error-free operation, specific speeds, or that the Service will work on every network, device, or in every country. You are responsible for the devices and software you use to access the Service.
5. Subscriptions, pricing & payment
- Plans, durations and prices are shown in the cabinet/website and may be offered in USD or EUR. Prices may include or exclude applicable taxes as indicated.
- Payments are processed by a third-party payment provider. By purchasing, you authorize the charge for the selected plan and any add-ons.
- A low-cost trial may be offered; trial terms are shown at purchase.
- Unless expressly stated, subscriptions do not auto-renew; access ends at the end of the paid period and you may purchase a new period to continue.
- You are responsible for any taxes, fees, or currency-conversion charges imposed by your bank or card issuer.
6. Right of withdrawal & refunds
The Service is digital content/services supplied immediately. By purchasing and activating the Service, you expressly request immediate performance and acknowledge that, to the extent permitted by law, you thereby lose any statutory right of withdrawal (including the EU 14-day cooling-off period) once provision has begun. Except where a refund is required by mandatory applicable law, payments are non-refundable. We may, at our sole discretion, offer a refund or credit.
7. Acceptable Use Policy
You agree not to use the Service to:
- violate any law or regulation, or infringe third-party rights (including intellectual property);
- distribute malware, conduct hacking, port-scanning, DDoS, spam, phishing, or other abusive/illegal activity;

- harass, threaten, or harm others, or impersonate any person or entity;
- resell, sublicense, or commercially redistribute the Service without our written consent;
- circumvent device limits, security, or usage restrictions, or share access beyond your plan;
- impose an unreasonable or disproportionately large load on our infrastructure.
We may investigate suspected violations and suspend or terminate access without notice where necessary, and cooperate with lawful authorities.
8. Suspension & termination
We may suspend or terminate your access for breach of these Terms, suspected fraud or abuse, non-payment, or where required by law. You may stop using the Service at any time. Sections that by their nature should survive termination (e.g. disclaimers, limitation of liability, governing law) will survive.
9. Intellectual property
The Service, website, software, branding, and content are owned by us or our licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended personal purpose. No other rights are granted.
10. Disclaimers
The Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, non-infringement, security, availability, or that the Service will meet your requirements. Some jurisdictions do not allow certain exclusions, so some may not apply to you.
11. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business, arising out of or related to the Service. Our total aggregate liability for any claim is limited to the amount you paid to us for the Service in the three (3) months preceding the event giving rise to the claim. Nothing limits liability that cannot be limited by law (e.g. for fraud, death or personal injury caused by negligence, or mandatory consumer rights).

You agree to indemnify and hold harmless us and our personnel from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service or your breach of these Terms or applicable law.

The Service relies on third parties (payment processing, analytics, infrastructure, VPN panel, app stores). We are not responsible for third-party services, and their own terms and privacy policies may apply.
14. Changes
We may modify the Service or these Terms. Material changes will be notified via the Service or email and take effect on the stated date. Continued use after that date constitutes acceptance. If you do not agree, stop using the Service.
15. Governing law & disputes
These Terms are governed by the laws applicable at the operator's place of establishment, without regard to conflict-of-laws rules, except where mandatory consumer-protection law grants you the right to bring proceedings in your place of residence.
16. Miscellaneous
- Severability — if any provision is unenforceable, the rest remain in effect.
- No waiver — failure to enforce a provision is not a waiver.
- Assignment — you may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
- Entire agreement — these Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
